To assign land in Zambia, you must obtain the consent of the President before proceeding [The Lands Act, S.5(1)]. This applies to all sales, transfers, or assignments of land.
The consent process works as follows: you must apply to the President for consent before assigning the land [The Lands Act, S.5(1)]. If the President does not respond within forty-five days of your application, consent is automatically deemed to have been granted [The Lands Act, S.5(2)]. If the President refuses consent, they must provide reasons within thirty days of the refusal [The Lands Act, S.5(3)].
If your consent application is refused, you have the right to appeal to the Lands Tribunal within thirty days of the refusal to seek redress [The Lands Act, S.5(4)]. Additionally, if you are assigning business premises under a tenancy arrangement, the owner of any reversionary interest in the property must also consent [The Landlord and Tenant (Business Premises) Act, S.7(b)].
